     PHOENIX, Ariz. (August 3, 2017) – W&W Structural, Inc., a woman-owned structural steel subcontractor, has added Bobby Esmilla as a Senior Estimator to its growing team in its Tempe, Ariz., office.

Copper Sky Land sells 40-acre parcel in North Scottsdale for $5.5M

     PHOENIX, ARIZ. (July 31, 2017) – Scottsdale-based investor and attorney Zach Sakas sold a 40-acre parcel of land in North Scottsdale for $5.5 million to Toll Brothers, a Pennsylvania-based luxury home builder.

Sakas, through his company Copper Sky Land LLC, acquired the land in February 2015. The property is located near 120th Street and Jomax Road. The property features dramatic boulder outcroppings and is adjacent to the Scottsdale McDowell Sonoran Preserve.

Rezoning of the property was completed in June.

Bret Rinehart, Ryan Semro, and Ben Heglie at Land Advisors Organization represented the seller.

“The property has gorgeous views of the Preserve, and it’s one of the few large pieces left in that area,” Sakas said.

Toll Brothers has not announced a name for its project or when development might begin. Public records indicate Sakas sold the property in excess of a 90 percent gain over his acquisition price.

“My co-investors are pleased with the outcome, and I’m grateful for their trust and confidence in me,” Sakas said.

Sakas owns another residential land project in North Scottsdale and is seeking additional residential land acquisition opportunities in Cave Creek, Carefree, Fountain Hills, and Scottsdale.

6th annual Mexican Baseball Fiesta returns to the Valley

The Mexican Winter Baseball League’s version of “Spring Training” will return to the Valley for the sixth consecutive year. The Mexican Baseball Fiesta will return to Sloan Park,  2330 W. Rio Salado Parkway in Mesa.

This year’s games will be on Sept. 30 and Oct. 1. Three of the top teams from the Liga Mexicana del Pacifico will participate: Los Naranjeros de Hermosillo, Águilas de Mexicali, and the Cañeros de Los Mochis.

>> Sunday, October 1, 2 p.m., doubleheader – game schedule TBD

“The Mexican Pacific League, is as popular in Mexico as Major League Baseball is in the U.S., if not more so,” said Francisco Gamez, Mexican Baseball Fiesta, founder, and LLC partner.

Gamez played over 10 years in the Mexican Pacific League as well as in the Milwaukee Brewers organization in the states. Constant excitement is the best way to describe the Mexican Baseball Fiesta.

Feder was a general manager in minor league baseball for 30 years (15 years in Tucson).

Mesa is one of a number of cities taking part in this year’s Mexican Baseball Fiesta. The other cities finalized are Tucson and Las Vegas.

Consumer insurance: You have worn out your welcome, but …

This is Part III of a blog series on consumer insurance policies cancelled or not renewed by an insurance company and addresses your response when you get the notice. In addressing the consequences for the cancellation of an auto policy or homeowner policy, we know that the first steps involve contacting the insurance company directly, or through your agent. Acting immediately may ensure success in staying insured. 

If contacting the insurance company failed to stop the cancellation or convince the insurance company to renew your policy, this commentary provides information about a little-known process available in Arizona and may apply in other states. If you object to the insurance company’s decision, the state insurance department or insurance commissioner may be helpful.

When the insurance company decides to cancel or not renew an insurance policy, this is an “adverse underwriting decision.”  Think of it as a divorce started by your insurance company.  Since you want to keep insurance on your mortgaged residence or want to follow the law by having auto insurance, the news that your insurance company wants to end the relationship is rarely welcome news.

An adverse underwriting decision happens when the insurance company has made a calculated decision based on hopefully “lawful” facts that you and your house or car will not be insured by that company, or that you have to pay a higher premium to stay insured.  This adverse underwriting decision may happen when you are applying for insurance, receive a cancellation notice or a notice to not renew your policy.

Arizona law defines six situations that may be an adverse underwriting decision and includes the cancellation or non-renewal of insurance coverage. ARS § 20-2102.

Typically, a notice of cancellation or non-renewal (“The Notice”) is sent by U.S. Mail, or by email because the notice date becomes important in determining next steps. You should act quickly and focus on protecting your rights using the process called an “Objection.”

Arizona policyholders can have the insurance company’s decision to cancel or not renew your insurance policy reviewed by the Director of the Arizona Department of Insurance.  You will need to contact the Director within 10 days of the notice and let the Director know that you “OBJECT” to the insurance company’s decision and want to preserve your rights under ARS § 20-1633.

Important information to have available includes your policy, claims history, premium payment history or any other documentation about your insurance company to support your position. Make copies of your documents and include them in your request for help from the Director. If you are not in Arizona, you may want to contact your own state’s insurance department or commissioner to determine whether similar rights are available in your home state or the state that issued the policy.

Once you contact the Director regarding your Objection, the Director must take certain steps to notify the insurance company of your appeal, and conduct an examination of the reasons for the cancellation.  The costs for the examination are paid by the insurance company.

If the Director reaches the conclusion that the reasons for the cancellation or non-renewal are “arbitrary, capricious or otherwise in violation of the law”, the Director can order the insurance company to cancel the cancellation as of the date of the notice to you.  ARS § 20-1633.B. Either party may appeal the Director’s decision to superior court.

The Objection process protects you because it places the cancellation or non-renewal on hold until the examination ends. This buys you time to shop for replacement insurance and you remain insured during the period that the Director conducts the examination.

If you miss the appeal deadline, you may still ask the department of insurance or your commissioner for help. In Arizona, you can contact the Arizona Department of Insurance, Consumer Affairs Division.

Remember, if you have a notice from your insurance company canceling or not renewing your policy, you want to act immediately to protect yourself and your property.

     PHOENIX, ARIZ. (July 25, 2017): The NAI Horizon investment sales team of Senior Vice Presidents Barbara Lloyd and Lane Neville represented the buyer in the $4.444 million acquisition of the CVS Pharmacy located at the NEC of Warner and Dobson roads in Chandler, Ariz.

The buyer is the Michael S. and Mary M. Cho Family Trust and was represented by NAI Horizon. The seller was Babytail III, LLC and was represented by Brad Richardson of Stan Johnson Company.

“After the successful sale of their Tempe mobile home park they owned for more than 40 years, we were able to assist our client in completing their 1031 exchange and acquire the CVS at Dobson and Warner,” Lloyd said.

“This was an ideal situation for our out-of-state client to 1031 exchange into a NNN leased, single-tenant retail investment,” Lloyd added.

A properly structured 1031 exchange allows an investor to sell a property, reinvest the proceeds in a new property, and defer all capital gain taxes.

“Our client’s 1031 exchange objective was to acquire a high-quality asset with limited downside risk,” Neville said. “Their acquisition of the CVS Pharmacy fulfilled their requirement. Our client has S&P BBB+ credit with CVS Health Corporation (NYSE: CVS). This helps ensure long-term stability for our client.”

Renovation plan attracts new entertainment, dining tenants, bringing new concepts to the Sedona community 

Sedona, Ariz.  (July 25, 2017) – Sedona Vista Village announces that the Majestic Theatre & Speakeasy Supper Club will be opening soon, occupying the 6,500-square-foot building which formerly housed the IMAX Theatre in the rear of the property.

The Majestic Theatre, which will accommodate 170 guests, will feature comedy on Thursday nights, a Friday Follies burlesque/variety show, live music on Saturday nights, and classic movies on Sundays. It is slated to open in September.

The Speakeasy Supper Club, which has seating for 100 in its unique 1920s designed theme dining room and outdoor back patio, will serve dinner and drinks Wednesday through Sunday.      PHOENIX, ARIZ. (July 24, 2017): The NAI Horizon investment sales team of Senior Vice Presidents Barbara Lloyd and Lane Neville represented the seller in the $4.05 million disposition of the Modernette Mobile Home Park, 1707 E. Apache Blvd. in Tempe, Ariz.

NAI Horizon represented the Michael S. and Mary M. Cho Family Trust.  The buyer was 2075 Cottonwood Office, LLC.

“Our client owned Modernette for more than 40 years and it was a reliably stable investment for them,” Lloyd said. “The property is less than one mile from Arizona State University and is strategically located along the light rail on Apache Boulevard, just west of the southwest corner of McClintock Drive.”

Modernette Mobile Home Park comprises 79 spaces and six apartment units. It sits on 4.8 acres.

“We are representing our client through this sale toward completion of a 1031 tax deferred exchange,” Neville said. “Their focus is to exchange proceeds from the mobile home park sale into an acquisition of a single tenant, retail asset.”
